The right to trial by jury

The right to trial by a citizen jury, free from government-mandated limits, is a constitutional right protected by the 7th Amendment. The best protection from a dangerous corporate nursing home, a reckless driver, a negligent hospital, a corrupt employer, an overreaching government, or any negligent act that causes you harm -- is your right to hold them accountable in a court of law. But year after year corporate lobbyists seek to weaken that right, through broad so-called “tort reforms,” or targeted liability immunity proposals. Iowa juries should decide court cases, not politicians and lobbyists. 

Workers' compensation

Workers' compensation attorneys represent employees who have been injured or become ill on the job. They help clients (claimants) navigate the workers' compensation system and ensure that their rights are protected. This includes filing claims, appealing denied claims, negotiating settlements, and representing clients in court if necessary. Work comp attorneys help clients obtain benefits such as medical expenses, lost wages, rehabilitation services, and other related costs. Too often, insurance companies fail to provide the work injury benefits required by law. Claimants attorneys make sure the insurance companies don't get away with it. 

Due process, right to counsel, and criminal justice

Our constitution requires due process, a fair trial, and the effective assistance of legal counsel when an individual is accused of a crime. After all, their very liberty is at stake. Government overreach is not justice. We fight for fair sentencing, for fair processes, and to empower the private and public criminal defense bar to take on even the toughest challenge. 

Insurance accountability and injury prevention

A free enterprise requires a reliable mechanism to enforce the duties owed to one another and the public. The civil justice system is the enforcement mechanism that ensures everyone plays by the same set of rules. Without it, wrongdoers gain an advantage over competitors who play by the rules. If you act negligently and cause harm you have to go face a jury, so judge accordingly when you make decisions every day. Lawsuits drive advancements in product, consumer, environmental, and health care safety, as well as accountability for bad faith by insurance carriers. 

Employment law

Workplace discrimination, harassment, abuse, corporate theft of wages, and wrongful termination can destroy an individual’s financial future, and their dignity. When this happens, Iowans must maintain the right to seek justice in court. And when contract tricks are implemented to rob Iowans of these rights — like forced arbitration clauses and non-compete clauses — these practices should be curbed or outlawed. Plaintiffs-side employment law attorneys level the playing field, safeguarding employee rights, and upholding labor laws. Without them, workers would face exploitation without recourse.

Fair courts

The people of Iowa established our judicial selection system by Constitutional Amendment in 1962, and it is one of the finest in the country. Iowa's merit selection and retention process works better than any other selection process to keep politics and campaign money out of our courts, and safeguard fairness and impartiality. Judges should be chosen on merit and retained through a lens of fitness for office. Attempts to corrupt that process with partisan political influence should be rejected. Iowans deserve fair and impartial courts that deliver justice equally to all.
